A restraining order is a court-ordered document designed to protect you from someone who has or can harm you. Though it doesn't always guarantee your safety, it is important to know when to file one.
Verbal Threats
If you are receiving hazardous verbal threats from another party, you should file a restraining order. Be sure to have proof (such as a witness, phone messages or written messages) of these threats when you arrive for court.
Stalking
If you are being stalked by someone, whether it's an ex, neighbor or coworker---it doesn't matter---file a restraining order. Stalking is obsessive behavior which can lead to your death and should not be taken lightly.
Violence
If you are being physically abused and your abuser seeks to continue this abuse, file a restraining order. Take steps to protect yourself in the meantime, like going to a domestic violence shelter until the restraining order is approved by the courts.
Children
If you have children and are being threatened or abused, do not hesitate to file a restraining order. Not only must you protect yourself, but your children are depending on you to protect them as well.
The Process
If you have a substantive case, a restraining order is not difficult to obtain. Simply visit the courthouse, file the papers, and show up for court on the date assigned by the court. If the judge sees your danger or likelihood of danger, he will grant you a restraining order for whatever duration he sees fit.
